TERMS OF SERVICE

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Deer Trail II Homeowners Association website located at https://www.deertrail2.com/ (the “Site”), operated by Deer Trail II Homeowners Association (“the Association,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Who This Site Is For

The Site is intended for use by homeowners, residents, board members, and other authorized users of Deer Trail II Homeowners Association.

3. Account Registration

The Site does not offer user accounts, and you do not need a login to use it. Resident portal logins are handled by IMC Management (see Section 6).

4. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any local, state, or federal law;
  • Post or transmit harassing, defamatory, obscene, or threatening content;
  • Attempt to gain unauthorized access to any part of the Site or connected systems;
  • Interfere with or disrupt the Site’s servers, networks, or security features;
  • Scrape, harvest, or collect information about other residents without authorization;
  • Upload viruses, malware, or other harmful code.

5. Third-Party Systems, Software, and Links

The Site integrates with, links to, or relies on third-party systems, software, platforms, and services (“Third-Party Services”), including but not limited to:

  • IMC Management’s resident portal (portal.imcmanagement.net), used for dues payments, architectural committee (ACC) requests, contact/notification preferences, and viewing meeting minutes and financial reports;
  • Our website hosting provider, used to host this website and store governing documents (bylaws, deed restrictions, fine and fee schedules, etc.);
  • Google Fonts, used to display the fonts on this website;
  • Any other hosting, email, payment, or software platform used now or in the future to operate the Site or deliver Association services.
  • We do not own, control, or operate these Third-Party Services, and we make no representations or warranties about their accuracy, reliability, availability, security, or content.
  • Your use of any Third-Party Service is governed by that provider’s own terms of service and privacy policy, which you are responsible for reviewing and accepting separately.
  • The Association is not responsible or liable for any loss, damage, service interruption, data breach, billing error, or other issue arising from or related to a Third-Party Service, including but not limited to payment processors, hosting providers, or software vendors used in connection with the Site.
  • Links to third-party websites are provided for convenience only and do not constitute an endorsement of that site or its content.

6. Payments and Resident Portal

Dues, assessments, ACC requests, and account/notification management are handled through the resident portal at portal.imcmanagement.net, operated by the Association’s management company, IMC Management, not by the Association directly. The Association does not store your payment card or bank account information. All transactions and portal use are subject to IMC Management’s own terms and privacy practices. The Association is not responsible for processing delays, declined transactions, login issues, or errors originating from the portal, IMC Management, or your financial institution. For portal access issues, contact the management company using the information in Section 14.

7. Content and Intellectual Property

All content on the Site (including the Association’s logo, governing documents, updates, and design) is the property of Deer Trail II Homeowners Association or its licensors and is provided for the personal, non-commercial use of residents and owners. You may not reproduce, distribute, or publicly display Site content without prior written permission, except as reasonably necessary to review your own community’s governing documents.

8. No Legal or Financial Advice

Information on the Site (including summaries of governing documents, rules, or assessment schedules) is provided for general informational purposes only and does not constitute legal, financial, or professional advice. The official, governing versions of the CC&Rs, bylaws, and rules are those on file with the Association; in case of any conflict, the official recorded documents control.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT AND SERVICES PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY THIRD-PARTY SYSTEM OR SOFTWARE CONNECTED TO THE SITE WILL FUNCTION WITHOUT ERROR.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Deer Trail II Homeowners Association, ITS BOARD MEMBERS, OFFICERS, VOLUNTEERS, MANAGEMENT COMPANY, AND WEBSITE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY THIRD-PARTY SYSTEM OR SOFTWARE ACCESSED THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless Deer Trail II Homeowners Association and its board members, volunteers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Site or your violation of these Terms.

12. Changes to the Site or Terms

We may modify, suspend, or discontinue the Site (or any part of it) at any time. We may also update these Terms from time to time; continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
